Are Mushroom Gummies Legal in Colorado?

Colorado's psilocybin framework: decrim + regulated access

In November 2022, Colorado voters passed Proposition 122, the Natural Medicine Health Act. It did two things:

  1. Decriminalized personal possession. As of 2023, adults 21 and older can possess, use, grow, and share psilocybin and psilocin for personal use without criminal penalty. This applies statewide, no city-by-city patchwork. Possession of up to 2 grams of psilocybin or 12 grams of psilocybin mushrooms is explicitly decriminalized.
  2. Created a regulated access model. Colorado is building a system of licensed "healing centers" where psilocybin can be administered by trained facilitators in supervised settings. These centers are expected to begin operations in 2026 or 2027. This is not retail, you can't walk in and buy gummies to take home. It's supervised, session-based administration.

What Proposition 122 did NOT do: legalize the commercial sale of psilocybin gummies. Online stores selling "psilocybin gummies shipped to Colorado" are operating outside the law. The regulated access model is the only legal pathway for psilocybin in Colorado, and it doesn't include gummies.

Bottom line: you can possess psilocybin mushrooms in Colorado without legal risk. You cannot buy psilocybin gummies online or in stores.


Entheogenic gummies: the legal path
