Psilocybin in California: illegal statewide, but enforcement varies wildly
Under California Health and Safety Code § 11054, psilocybin is a Schedule I controlled substance. Possession for personal use is technically a misdemeanor, but in practice, it's almost never prosecuted as a standalone charge in the cities that have decriminalized.

The decriminalization measures only reduce the risk of arrest for personal use and possession of small amounts.
At the state level, reform efforts have stalled. Senate Bill 58, which would have decriminalized natural psychedelics statewide, was vetoed by Governor Newsom in 2023. A revised version introduced in 2024 has not advanced. The political appetite for statewide reform exists but hasn't yet translated into law.
